विशेष अधिकार

• धारा 370 के प्रावधानों के अनुसार, संसद को जम्मू-कश्मीर के बारे में रक्षा, विदेश मामले और संचार के विषय में कानून बनाने का अधिकार है लेकिन किसी अन्य विषय से सम्बन्धित क़ानून को लागू करवाने के लिये केन्द्र को राज्य सरकार का अनुमोदन चाहिये।
• इसी विशेष दर्ज़े के कारण जम्मू-कश्मीर राज्य पर संविधान की धारा 356 लागू नहीं होती।
• इस कारण राष्ट्रपति के पास राज्य के संविधान को बर्ख़ास्त करने का अधिकार नहीं है।
• 1976 का शहरी भूमि क़ानून जम्मू-कश्मीर पर लागू नहीं होता।
• इसके तहत भारतीय नागरिक को विशेष अधिकार प्राप्त राज्यों के अलावा भारत में कहीं भी भूमि ख़रीदने का अधिकार है। यानी भारत के दूसरे राज्यों के लोग जम्मू-कश्मीर में ज़मीन नहीं ख़रीद सकते।
• भारतीय संविधान की धारा 360 जिसके अन्तर्गत देश में वित्तीय आपातकाल लगाने का प्रावधान है, वह भी जम्मू-कश्मीर पर लागू नहीं होती।
• जम्मू और कश्मीर का भारत में विलय करना ज़्यादा बड़ी ज़रूरत थी और इस काम को अंजाम देने के लिये धारा 370 के तहत कुछ विशेष अधिकार कश्मीर की जनता को उस समय दिये गये थे। ये विशेष अधिकार निचले

विशेष अधिकारों की सूची

1. जम्मू-कश्मीर के नागरिकों के पास दोहरी नागरिकता होती है।
2. जम्मू-कश्मीर का राष्ट्रध्वज अलग होता है।
3. जम्मू - कश्मीर की विधानसभा का कार्यकाल 6 वर्षों का होता है जबकि भारत के अन्य राज्यों की विधानसभाओं का कार्यकाल 5 वर्ष का होता है।
4. जम्मू-कश्मीर के अन्दर भारत के राष्ट्रध्वज या राष्ट्रीय प्रतीकों का अपमान अपराध नहीं होता है।
5. भारत के उच्चतम न्यायालय के आदेश जम्मू-कश्मीर के अन्दर मान्य नहीं होते हैं।
6. भारत की संसद को जम्मू-कश्मीर के सम्बन्ध में अत्यन्त सीमित क्षेत्र में कानून बना सकती है।
7. जम्मू-कश्मीर की कोई महिला यदि भारत के किसी अन्य राज्य के व्यक्ति से विवाह कर ले तो उस महिला की नागरिकता समाप्त हो जायेगी। इसके विपरीत यदि वह पकिस्तान के किसी व्यक्ति से विवाह कर ले तो उसे भी जम्मू-कश्मीर की नागरिकता मिल जायेगी।
8. धारा 370 की वजह से कश्मीर में आरटीआई (RTI) और सीएजी (CAG) जैसे कानून लागू नहीं होते है।
9. कश्मीर में महिलाओं पर शरियत कानून लागू है।
10. कश्मीर में पंचायत को अधिकार प्राप्त नहीं है।
11. कश्मीर में चपरासी को 2500 रूपये ही मिलते है।
12. कश्मीर में अल्पसंख्यकों [हिन्दू-सिख] को 16% आरक्षण नहीं मिलता।
13. धारा 370 की वजह से कश्मीर में बाहर के लोग जमीन नहीं खरीद सकते हैं।
14. धारा 370 की वजह से ही कश्मीर में रहने वाले पाकिस्तानियों को भी भारतीय नागरिकता मिल जाती है।

धारा ३७० के सम्बन्ध में कुछ विशेष बातें

१) धारा ३७० अपने भारत के संविधान का अंग है।

२) यह धारा संविधान के २१वें भाग में समाविष्ट है जिसका शीर्षक है- ‘अस्थायी, परिवर्तनीय और विशेष प्रावधान’ (Temporary, Transitional and Special Provisions)।

३) धारा ३७० के शीर्षक के शब्द हैं - जम्मू-कश्मीर के सम्बन्ध में अस्थायी प्रावधान (“Temporary provisions with respect to the State of Jammu and Kashmir”)।

४) धारा ३७० के तहत जो प्रावधान है उनमें समय समय पर परिवर्तन किया गया है जिनका आरम्भ १९५४ से हुआ। १९५४ का महत्त्व इस लिये है कि १९५३ में उस समय के कश्मीर के वजीर-ए-आजम शेख महम्मद अब्दुल्ला, जो जवाहरलाल नेहरू के अंतरंग मित्र थे, को गिरफ्तार कर बंदी बनाया था। ये सारे संशोधन जम्मू-कश्मीर के विधानसभा द्वारा पारित किये गये हैं।

संशोधित किये हुये प्रावधान इस प्रकार के हैं-

(अ) १९५४ में चुंगी, केंद्रीय अबकारी, नागरी उड्डयन और डाकतार विभागों के कानून और नियम जम्मू-कश्मीर को लागू किये गये।

(आ) १९५८ से केन्द्रीय सेवा के आई ए एस तथा आय पी एस अधिकारियों की नियुक्तियाँ इस राज्य में होने लगीं। इसी के साथ सी ए जी (CAG) के अधिकार भी इस राज्य पर लागू हुए।

(इ) १९५९ में भारतीय जनगणना का कानून जम्मू-कश्मीर पर लागू हुआ।

(र्ई) १९६० में सर्वोच्च न्यायालय ने जम्मू-कश्मीर उच्च न्यायालय के निर्णयों के विरुद्ध अपीलों को स्वीकार करना शुरू किया, उसे अधिकृत किया गया।

(उ) १९६४ में संविधान के अनुच्छेद ३५६ तथा ३५७ इस राज्य पर लागू किये गये। इस अनुच्छेदों के अनुसार जम्मू-कश्मीर में संवैधानिक व्यवस्था के गड़बड़ा जाने पर राष्ट्रपति का शासन लागू करने के अधिकार प्राप्त हुए।

(ऊ) १९६५ से श्रमिक कल्याण, श्रमिक संगठन, सामाजिक सुरक्षा तथा सामाजिक बीमा सम्बन्धी केन्द्रीय कानून राज्य पर लागू हुए।

(ए) १९६६ में लोकसभा में प्रत्यक्ष मतदान द्वारा निर्वाचित अपना प्रतिनिधि भेजने का अधिकार दिया गया।

(ऐ) १९६६ में ही जम्मू-कश्मीर की विधानसभा ने अपने संविधान में आवश्यक सुधार करते हुए- ‘प्रधानमन्त्री’ के स्थान पर ‘मुख्यमन्त्री’ तथा ‘सदर-ए-रियासत’ के स्थान पर ‘राज्यपाल’ इन पदनामों को स्वीकृत कर उन नामों का प्रयोग करने की स्वीकृति दी। ‘सदर-ए-रियासत’ का चुनाव विधानसभा द्वारा हुआ करता था, अब राज्यपाल की नियुक्ति राष्ट्रपति द्वारा होने लगी।

(ओ) १९६८ में जम्मू-कश्मीर के उच्च न्यायालय ने चुनाव सम्बन्धी मामलों पर अपील सुनने का अधिकार सर्वोच्च न्यायालय को दिया।

(औ) १९७१ में भारतीय संविधान के अनुच्छेद २२६ के तहत विशिष्ट प्रकार के मामलों की सुनवाई करने का अधिकार उच्च न्यायालय को दिया गया।

(अं) १९८६ में भारतीय संविधान के अनुच्छेद २४९ के प्रावधान जम्मू-कश्मीर पर लागू हुए।

(अः) इस धारा में ही उसके सम्पूर्ण समाप्ति की व्यवस्था बताई गयी है। धारा ३७० का उप अनुच्छेद ३ बताता है कि ‘‘पूर्ववर्ती प्रावधानों में कुछ भी लिखा हो, राष्ट्रपति प्रकट सूचना द्वारा यह घोषित कर सकते है कि यह धारा कुछ अपवादों या संशोधनों को छोड दिया जाये तो समाप्त की जा सकती है।

इस धारा का एक परन्तुक (Proviso) भी है। वह कहता है कि इसके लिये राज्य की संविधान सभा की मान्यता चाहिये। किन्तु अब राज्य की संविधान सभा ही अस्तित्व में नहीं है। जो व्यवस्था अस्तित्व में नहीं है वह कारगर कैसे हो सकती है?

जवाहरलाल नेहरू द्वारा जम्मू-कश्मीर के एक नेता पं॰ प्रेमनाथ बजाज को २१ अगस्त १९६२ में लिखे हुये पत्र से यह स्पष्ट होता है कि उनकी कल्पना में भी यही था कि कभी न कभी धारा ३७० समाप्त होगी। पं॰ नेहरू ने अपने पत्र में लिखा है-

‘‘वास्तविकता तो यह है कि संविधान का यह अनुच्छेद, जो जम्मू-कश्मीर राज्य को विशेष दर्जा दिलाने के लिये कारणीभूत बताया जाता है, उसके होते हुये भी कई अन्य बातें की गयी हैं और जो कुछ और किया जाना है, वह भी किया जायेगा। मुख्य सवाल तो भावना का है, उसमें दूसरी और कोई बात नहीं है। कभी-कभी भावना ही बडी महत्त्वपूर्ण सिद्ध होती है।’’

Near riots ensued, and one fan even traded his car for a packet of the sauce. But McDonald’s was eventually able to assuage fans when it brought the sauce back on a wider scale this year. It’s not clear that Build-a-Bear will get a similar chance to make good on its broken promise.

Sure, everyone likes to save a few bucks, but our thirst for these bargains runs deeper (cue the promos for Amazon’s Prime Day).



First and foremost, the Build-a-Bear fiasco reminds us that FOMO (Fear of Missing Out) is not just an online phenomenon – although online behavior fuels the fire exponentially. We know that many American parents are, shall we say, a bit competitive. They’re not going to stand idly by while their kids’ friends snag a cool new teddy bear and their little prince or princess goes empty-handed. Some economists suggest that exciting new market entries can become "phantastic objects" that skew our sense of reason as we suspend logic to pursue them. After all, this is our kids we’re talking about here! And the relative scarcity of these furry finds of course enhances the need to procure one – now. Build-A-Bear announced its Pay Your Age event earlier this week. Customers who show up at the stores can pay their current age for the popular stuffed animals. On Wednesday, the retailer wrote on its Facebook page that it was "anticipating the potential of long lines and wait times."
Shoppers braving the wait times shared photos and videos of lines snaking down the halls of malls and shopping areas.


Allison Viron, from McMurray, Pennsylvania, got in line outside the Build-A-Bear South Hills Village location in Pittsburgh around 9:15 a.m. to get stuffed animals for her daughters, Caroline and Catharine, ages 1 and 3.


"The line was cut off sometime in the 10 a.m. hour," Viron said, adding that she was still in line inside the store at 4 p.m., and there were "hundreds of people behind" her.

Alex Sullivan took her 4-year-old daughter Madison to the Westfield Countryside Mall in Clearwater, Florida. They arrived shortly before 8 a.m.

Sullivan said doors opened earlier and they were able to leave the mall -- with a stuffed animal that smelled like cotton candy and a happy child -- before 1 p.m.

"It was obviously very difficult for [the store] to control the line and the people in it or trying to get in it or around it," Sullivan said. "However, the staff members inside the store still did an amazing job making the experience special for children making their build-a-bears."

The store distributed vouchers for customers who waited in line but left without a stuffed animal and will also make the vouchers available to US and Canada Build-A-Bear Bonus Club members who log into their account by Sunday, July 15. The coupons will be honored through August 31, the statement said.


"Our goal with the voucher extension is to enable us to better flow traffic to the stores over the next several weeks to avoid long lines and wait times as much as possible," the store added in the statement.
